He does. Earth law just isn't set up to deal with aliens, most people don't even know aliens exist and are visiting earth, not always in a friendly or law abiding manner. Torchwood doesn't enjoy killing, but sometimes they're left with no better choice and then they have to do what's necessary as efficiently as possible.
